Abstract

El presente estudio tiene como propósito analizar el papel que ha jugado el diálogo social en España ante el fenómeno migratorio. Una de las instituciones que materializa el diálogo social en dicho país es el Consejo Económico y Social (CES), en cuya composición se encuentran representantes de sindicatos, sector privado y sector público. Se inicia analizando el concepto de «diálogo social» desde una perspectiva amplia, incluyendo modelos tripartitos y participativos, destacando su potencial para abordar desafíos laborales y sociales relacionados con la migración. A continuación, se ofrece un diagnóstico actualizado sobre el fenómeno migratorio en España, resaltando su impacto en el mercado laboral, el crecimiento demográfico y la sostenibilidad del sistema de pensiones. Se identifican nacionalidades predominantes, sectores de empleo y desafíos estructurales como el envejecimiento poblacional. En el siguiente apartado, se contextualiza el diálogo social en Europa y España, explicando la estructura, funciones y composición del CES. Se examina su capacidad de influencia, sus límites jurídicos, su relevancia como plataforma institucional de deliberación y consulta, y se profundiza en los aportes mediante el análisis de documentos que evidencian un enfoque evolutivo e interseccional, pasando de una visión laboral a una integral basada en derechos humanos. El artículo concluye que el CES ofrece una visión real del fenómeno y ha visibilizado a la población migrante como sujeto de derechos, aunque persisten desafíos como la falta de impacto y representatividad directa, y la no vinculación de sus dictámenes. [The present study aims to analyze the role that social dialogue has played in Spain in response to the migration phenomenon. One of the institutions that embodies social dialogue in the country is the Economic and Social Council (ESC, by its acronym in Spanish: CES), which includes representatives from trade unions, the private sector, and the public sector. The study begins by examining the concept of “social dialogue” from a broad perspective, incorporating both tripartite and participatory models, and highlighting its potential to address labor and social challenges related to migration. Next, an up-to-date assessment of the migration phenomenon in Spain is provided, emphasizing its impact on the labor market, demographic growth, and the sustainability of the pension system. The analysis identifies predominant nationalities, employment sectors, and structural challenges such as population aging. Subsequently, the study contextualizes social dialogue within the European and Spanish frameworks, detailing the structure, functions, and composition of the ESC. It examines its capacity for influence, its legal limitations, and its relevance as an institutional platform for deliberation and consultation. Particular attention is given to the Council’s contributions through an analysis of documents that reflect an evolving and intersectional approach, shifting from a labor-oriented vision to a comprehensive framework grounded in human rights. The article concludes that the CES provides a realistic perspective on the migration phenomenon and has contributed to the visibility of the migrant population as rights-holders.
